MARLIN LIGHTING Product Warranty

Effective Date: 01 January 2025

MARLIN LIGHTING (“we,” “our,” “us”) warrants that its products will be free from defects in materials and workmanship under normal use and service for the periods defined below. This warranty is granted to the original purchaser (“buyer,” “you”).

1. Warranty Duration

  • MARLIN LIGHTING Manufactured Products: A period of five (5) years from the original date of shipment. This includes all products designed and built by MARLIN LIGHTING , including but not limited to luminaires, structural components, and finished goods.

  • Third-Party Components & Accessories: For products, components, or sub-assemblies not manufactured by us (such as drivers, sensors, controls, or proprietary parts sourced from suppliers), the warranty period is as specified in their respective product documentation but will not be less than five (5) years.

2. What This Warranty Covers

If a product is defective during its warranty period, we will, at our sole option:

  • Repair the product, or

  • Replace the product with a new or refurbished unit.

This is your exclusive remedy. For products designed and manufactured by MARLIN LIGHTING, this warranty also covers any claim that the product infringes upon a third party’s intellectual property rights.

3. What This Warranty Does Not Cover

This warranty does not cover defects or damage resulting from:

  • Improper Use or Installation: Failure to install, operate, or maintain the product per our supplied instructions, technical data sheets, and applicable codes and standards.

  • External Factors: Damage from accident, abuse, misuse, neglect, acts of God (e.g., lightning, floods, earthquakes), power surges, or use outside the product’s specified environmental or operational limits.

  • Unauthorized Modifications: Any product that has been modified, altered, or repaired by anyone not authorized by us, or whose serial number or manufacturing code has been removed, defaced, or altered.

  • Normal Wear and Tear: The natural aging of materials, cosmetic deterioration, or wear that does not impair core functionality.

  • Buyer-Provided Designs or Specifications: Defects arising from designs, specifications, or instructions provided by the buyer.

4. How to Make a Warranty Claim

To obtain warranty service, you must:

  1. Notify Us: Contact your MARLIN LIGHTING representative or our customer service department in writing within 30 days of discovering the defect.

  2. Provide Details: Submit a detailed description of the defect, the product’s model and serial numbers, and proof of purchase (e.g., Invoice number/ Purchase Order number).

  3. Cooperate: Work with our team to diagnose the issue, which may include returning the product to us for inspection as requested.

5. Important Limitations of Liability

THE REMEDIES OF REPAIR OR REPLACEMENT ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH OF WARRANTY. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL MARLIN LIGHTING BE LIABLE FOR:

  • Any costs associated with the removal of the defective product or the installation of a replacement, including but not limited to labor, transportation, and craneage.

  • Any costs for work on other equipment, structures, or property.

  • Any consequential, incidental, indirect, special, or punitive damages, including but not limited to loss of profits, production, revenue, or data, however caused.

6. Governing Law and Dispute Resolution

This warranty and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of laws principles.

Any legal suit, action, or proceeding arising from this warranty shall be brought exclusively in the courts of Milan, Italy, and you hereby irrevocably submit to the jurisdiction of these courts.

7. Complete Agreement

This Warranty Policy is incorporated by reference into the MARLIN LIGHTING General Terms and Conditions of Sale.

These documents constitute the entire agreement between you and MARLIN LIGHTING concerning the product warranty. This online policy is provided for your convenience and summarizes key terms. However, in the event of any conflict or ambiguity, the provisions of the General Terms and Conditions of Sale shall control. We reserve the right to amend these terms at our discretion, and the version in effect at the time of your purchase will apply.
